Welcome to the Your Radiant Skin® website located at yourradiantskin.com (the “Site”). The Site is operated by The Skin Atelier, Inc., a New York corporation doing business as Your Radiant Skin® (“Your Radiant Skin®,” “we,” “us,” or “our”).

These Terms of Use & Sale (the “Terms”) govern your access to and use of the Site and your purchase of products and services offered through the Site.

1) Agreement to Terms

By accessing or using the Site, creating an account, placing an order, enrolling in an auto‑replenishment subscription, signing up for emails, opting into SMS marketing, or otherwise interacting with the Site, you agree to be bound by these Terms.

If you do not agree, do not use the Site.

2) Incorporated Policies

These Terms incorporate by reference any policies and notices we post on the Site, including without limitation:

  • our Privacy Policy (how we collect/use/share personal information),
  • our Return & Refund Policy (refund/return eligibility, timeframes, and process),
  • any Shipping Policy,
  • Rewards/Referral Program terms, and
  • any additional terms shown at checkout or in connection with specific programs or promotions.

If there is a conflict, the program‑specific terms (e.g., Auto‑Replenishment Terms or Messaging Terms) control for that program.

3) Eligibility

You must be at least 18 years old (or the age of majority where you live, if higher) and able to form a legally binding contract to use the Site and purchase products.

4) Definitions

  • “Products” means the skincare and related products offered for sale on the Site.
  • “Content” means all text, images, videos, graphics, audio, product descriptions, blog content, and other materials on the Site.
  • “Account” means a registered user account on the Site.
  • “Auto‑Replenishment” / “Subscription” means any recurring shipment or recurring order program where Products ship and/or you are charged on a repeating schedule unless cancelled.
  • “User Content” means reviews, comments, testimonials, photos, videos, or other content you submit or post.

5) Medical / Educational Disclaimers (No Medical Advice)

The Site and Content are for general informational purposes only. Our Products and Content are not intended to diagnose, treat, cure, or prevent any disease and are not medical advice.

6) Changes to These Terms

We may update these Terms at any time by posting an updated version on the Site. The “Last Updated” date reflects the latest revision. Changes apply going forward from the posting date, except where law requires otherwise.

7) Accounts & Security

If you create an Account:

  • You agree to provide accurate, current, and complete information.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for activity under your Account, including purchases, unless prohibited by law.
  • We may suspend or terminate Accounts in our discretion (e.g., suspected fraud, abuse, or violations of these Terms).

8) Product Information, Pricing & Availability

We try to display Products, ingredients, pricing, and availability accurately, but errors can occur.

  • Product descriptions and images: Colors and appearance may vary by device and display settings.
  • Pricing/typographical errors: If an item is listed at an incorrect price or with incorrect information, we may cancel or refuse the order (even after confirmation). If you were charged and we cancel, we will issue a refund to the original payment method.
  • Availability: Products may be limited or discontinued without notice.

9) Orders, Order Acceptance & Payments

9.1 Order Acceptance

Your order is an offer to purchase. We may accept, decline, limit quantities, or cancel orders in our discretion, including to prevent fraud or unauthorized activity.

9.2 Payment Authorization

When you place an order, you authorize us (and our payment processors) to charge your payment method for:

  • product price(s),
  • shipping/handling (if applicable),
  • taxes (if applicable), and
  • any other amounts disclosed at checkout.

You represent that you have the legal right to use the payment method provided.

9.3 Taxes

Sales tax may be collected where required. Tax estimates at checkout may change based on final shipment details.

9.4 Payment Processors & “Pay Over Time” Options

We may offer third‑party payment methods or “pay over time”/installment options through third parties. Those services are provided by the third party and may be subject to the third party’s terms, fees, eligibility criteria, credit checks, and privacy practices. We are not responsible for third‑party services.

10) Shipping, Delivery & Risk of Loss

Shipping options, costs, and estimated delivery times are displayed during checkout or in a shipping policy we post.

  • Delivery estimates are not guarantees.
  • Once an order is handed to the carrier, delays may occur outside our control.
  • Risk of loss and title transfer are governed by applicable law; to the maximum extent permitted, risk of loss passes to you upon delivery to the carrier.
  • You are responsible for providing an accurate shipping address. If an order is returned due to an address error, we may require additional shipping fees to reship.

11) Returns, Refunds & Exchanges

Our Return & Refund Policy (posted on the Site) describes eligibility, time limits, exclusions, and how to request a return/refund.

Key baseline terms (unless our posted Return & Refund Policy states otherwise):

  1. Return window: Return requests must be submitted within the timeframe stated in the Return & Refund Policy (commonly 30 days from delivery, but your posted policy controls).
  2. Condition: Items must be unused, unopened, and in original packaging (unless the policy states otherwise).
  3. Non‑returnable items: Gift cards, final sale items, and certain promotional items may be non‑refundable except as required by law.
  4. Refund method: Approved refunds are issued to the original payment method unless otherwise required by law.
  5. Shipping fees: Original shipping/handling may be non‑refundable unless required by law or our policy states otherwise.

Important: We will display or link our Return & Refund Policy in the manner required by applicable law (including for online retailers), such as near product listings and/or prior to requesting billing information.

12) Gift Cards

  • Gift cards are redeemable only for eligible purchases on the Site, unless otherwise stated.
  • Gift cards are generally non‑refundable and not redeemable for cash except as required by law.
  • We are not responsible for lost or stolen gift cards to the extent permitted by law.

13) Auto‑Replenishment / Subscription Terms (Automatic Renewal)

These Auto‑Replenishment Terms apply if you select a recurring delivery option (for example, “Ship Every Month,” “Ship Every 2‑Months,” “Ship Every 3‑Months,” or any other interval offered).

13.1 Automatic Renewal; Recurring Charges

By enrolling, you agree that:

  • Your subscription will continue at the selected frequency until you cancel.
  • We will charge your payment method automatically for each recurring order at the price, frequency, and cadence disclosed at signup/checkout (plus applicable taxes and shipping/handling if applicable).
  • You authorize us to charge your payment method for recurring orders without requiring additional authorization each time.

13.2 Price Changes / Introductory Discounts

If your subscription includes a promotional price, introductory discount, free gift, or free/discounted trial, we will disclose how and when pricing changes and what price(s) will apply thereafter at the time you enroll.

Prices for Products, shipping, and taxes may change over time. If a price increases beyond what was disclosed at the time you consented, we will provide notice and/or obtain consent and provide cancellation/refund options as required by applicable law.

13.3 Order Timing

Recurring orders are generated and billed on or about the schedule shown during enrollment and/or in your Account subscription settings.

13.4 How to Cancel (Simple Cancellation)

You may cancel your subscription at any time using a simple mechanism, including:

  • by logging into your Account and cancelling within subscription settings (if available), and/or
  • by contacting us using the methods listed in the Contact Us section.

We will not require you to take steps that unreasonably obstruct or delay your ability to cancel.

13.5 Cancellation Deadline to Avoid the Next Charge

To avoid being charged for the next recurring order, you must cancel before the next scheduled renewal/processing time shown in your Account or enrollment confirmation. For practical processing, we recommend cancelling at least 24 hours before the next scheduled renewal date/time.

If you cancel after an order has been processed, the cancellation may apply to future orders and the processed order will be handled under our Return & Refund Policy (unless prohibited by law).

13.6 Confirmation / Acknowledgement

After you enroll, we will send an acknowledgement (such as an email) that includes the material subscription terms and how to cancel, in a form that you can retain.

13.7 No Subscription Required

Your enrollment in Auto‑Replenishment is optional. Consent to subscription billing is not a condition of purchase for one‑time orders.

14) Rewards Program & Referrals

  • Participation is optional and subject to the program terms posted on the Site.
  • We may change or discontinue the program, point values, redemption rules, eligible actions, and rewards at any time, subject to applicable law.
  • We may suspend or terminate accounts for suspected abuse, fraud, or attempts to game the program.

15) Promotions; Coupon Codes

Promotions, discounts, and coupon codes:

  • have no cash value unless required by law,
  • may have eligibility rules and expiration dates,
  • may be limited to one per customer or one per order,
  • may be modified or ended at any time.

16) Email Communications, Subscriptions & Marketing

16.1 Transactional vs. Marketing Emails

When you place an order or create an Account, we may send you transactional emails (e.g., order confirmations, shipping updates, security notices). Transactional emails are necessary to provide the services you request.

If you sign up for our newsletter, promotions, or marketing communications (for example, by entering your email into a subscription form or checking a marketing opt‑in box), you consent to receive marketing emails, which may include promotions, product updates, and special offers.

16.2 Unsubscribe / Opt‑Out

You can opt out of marketing emails at any time by using the unsubscribe link in our emails or contacting us. Opting out of marketing emails does not affect transactional communications related to your purchases or Account.

16.3 Consent Not Required to Buy

Your consent to receive marketing emails is not a condition of purchase.

17) SMS/MMS Messaging Terms (Marketing & Informational Texts)

These Messaging Terms apply if you opt in to receive SMS/MMS messages from us (the “Messaging Program”). This includes recurring automated marketing texts and may include informational texts.

17.1 Opt‑In and Consent

By opting in, you agree to receive recurring automated marketing and informational text messages from Your Radiant Skin® at the mobile number you provided. Messages may be sent using an autodialer or automated system.

You represent that:

  • you are the owner or authorized user of the mobile number you provide, and
  • you are at least 18 years old (or the age of majority where you live).

Consent to receive marketing text messages is not a condition of purchase.

17.2 Message Frequency

Message frequency varies and depends on your interactions, account activity, promotions, and program settings.

17.3 Costs

Message and data rates may apply. Check your wireless plan with your carrier.

17.4 Supported Carriers / Delivery

Carriers are not liable for delayed or undelivered messages. The Messaging Program may not be available on all carriers or in all regions.

17.5 How to Opt Out

You can cancel at any time by texting STOP (or any other commonly recognized opt‑out keyword such as END, CANCEL, UNSUBSCRIBE, or QUIT). After you send STOP, we will send a confirmation message and you will no longer receive messages, except as permitted by law (e.g., a final confirmation).

17.7 Changes to Phone Number

If you change or deactivate your mobile number, you agree to opt out (text STOP) before changing your number or notify us at info@yourradiantskin.com so we can update our records.

We may change or terminate the Messaging Program at any time (including changing the sending phone number or short code). We may also update these Messaging Terms by posting an updated version on the Site. Your continued participation constitutes acceptance of the updated Messaging Terms.

17.9 Privacy

Your participation is subject to our Privacy Policy. We may share your information with service providers who help us deliver messages and operate the program. We do not control carrier practices.

18) User Content: Reviews, Comments, Testimonials

If you submit User Content (including product reviews, photos, or testimonials), you agree that:

  • you own or have the necessary rights to submit it;
  • it is not unlawful, defamatory, infringing, deceptive, or misleading;
  • it does not include confidential information or third‑party personal data you do not have permission to share.

License to Us

You grant us a non‑exclusive, worldwide, royalty‑free, sublicensable, transferable license to use, reproduce, display, distribute, and create derivative works from your User Content in connection with our business (including marketing, product pages, and social media), subject to applicable law.

No Gag on Honest Reviews

Nothing in these Terms is intended to prohibit lawful, honest reviews or other protected consumer speech.

19) Intellectual Property

The Site, Content, and all related intellectual property are owned by or licensed to Your Radiant Skin® and are protected by applicable laws. You may use the Site for personal, non‑commercial purposes only.

Trademarks, logos, and service marks (including “Your Radiant Skin®” and related marks) may not be used without our prior written permission.

20) Prohibited Uses

You agree not to:

  • scrape, mine, or harvest data from the Site;
  • interfere with Site security or functionality;
  • post malware or malicious code;
  • engage in fraud or unauthorized commercial activity;
  • impersonate others or misrepresent affiliation.

We may suspend or terminate access for violations.

21) Third‑Party Links and Services

The Site may link to third‑party sites or services. We do not control and are not responsible for third‑party content, terms, privacy practices, or actions.

22) Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE, CONTENT, AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.

We do not guarantee uninterrupted operation, error‑free content, or any particular result from use of Products.

23) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOUR RADIANT SKIN® AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PURCHASE/USE OF PRODUCTS.

Some jurisdictions do not allow certain limitations; in those jurisdictions, liability is limited to the maximum extent permitted by law.

24) Indemnification

You agree to indemnify and hold harmless Your Radiant Skin® and its affiliates and representatives from claims, damages, liabilities, and expenses (including attorneys’ fees) arising from your breach of these Terms, your User Content, or your misuse of the Site.

25) Copyright / DMCA Notice

If you believe content on the Site infringes your copyright, send a notice including:

  • your signature (physical or electronic),
  • identification of the copyrighted work,
  • identification/location of the allegedly infringing material,
  • your contact information,
  • a statement of good‑faith belief the use is unauthorized, and
  • a statement under penalty of perjury that the notice is accurate.

26) Governing Law; Venue; Class Action Waiver

These Terms are governed by the laws of the State of New York (without regard to conflicts principles).

Any dispute arising out of or relating to these Terms, the Site, Products, Auto‑Replenishment, email communications, or the Messaging Program shall be brought exclusively in the state or federal courts located in Orange County, New York, and you consent to jurisdiction and venue there.

Class Action Waiver: To the maximum extent permitted by law, you agree not to bring or participate in a class action against Your Radiant Skin®.

27) Time Limit to Bring Claims

To the maximum extent permitted by law, any claim must be brought within one (1) year after the event giving rise to the claim, unless a longer period is required by law.

28) Miscellaneous

  • Severability: If any provision is unenforceable, the remainder remains in effect.
  • No Waiver: Failure to enforce is not a waiver.
  • Assignment: You may not assign your rights without our consent; we may assign freely.
  • Force Majeure: We are not liable for delays due to events beyond our reasonable control.
